§1 Cancellation Policy
Right of Withdrawal
You may cancel your contract within 14 days without providing a reason, either in writing (e.g., letter, email) or—if the item is delivered to you before the deadline expires—by returning the item. The period begins upon receipt of this notice in writing, but not before the goods are received by the recipient (in the case of recurring deliveries of similar goods, not before receipt of the first partial delivery) and not before we have fulfilled our information obligations pursuant to Article 246 § 2 in conjunction with § 1, paragraphs 1 and 2 of the EGBGB, as well as our obligations pursuant to § 312g, paragraph 1, sentence 1 of the BGB in conjunction with Article 246 § 3 of the EGBGB. To comply with the withdrawal period, it is sufficient to send the notice of withdrawal or return the goods in a timely manner. The notice of withdrawal must be sent to:

Consequences of Cancellation
In the event of a valid cancellation, the performance received by both parties must be returned, and any benefits derived (e.g., interest) must be surrendered. If you are unable to return or surrender the performance received and any benefits derived therefrom (e.g., benefits of use), or if you can do so only in part or only in a deteriorated condition, you must compensate us for the corresponding loss in value. You are only required to provide compensation for the deterioration of the item and for any benefits derived to the extent that such benefits or deterioration result from handling the item in a manner that goes beyond what is necessary to examine its characteristics and functionality. “Checking the properties and functionality” refers to testing and trying out the respective goods, as is possible and customary in a retail store. Items suitable for shipment by package must be returned at our risk. You are responsible for the standard costs of return shipping if the delivered goods correspond to those ordered and are not damaged. In the event of a complaint due to an error on our part, return shipping is, of course, free of charge for you. Obligations to refund payments must be fulfilled within 30 days. For you, this period begins when you send your notice of withdrawal or the item; for us, it begins upon receipt.

§ 2 Scope of Application
(1) The following General Terms and Conditions (GTC) apply to all deliveries and services provided by the Fair IT yourself e.V. association in connection with orders placed through the online store in business transactions with consumers as defined in Section 13 of the German Civil Code (BGB) and entrepreneurs as defined in Section 14 of the German Civil Code (BGB). A consumer is any natural person who enters into a legal transaction for a purpose that cannot be attributed to either their commercial or self-employed professional activity. An entrepreneur is a natural person, a legal entity, or a partnership with legal capacity that, when entering into a legal transaction, acts in the course of its commercial or self-employed professional activity.
(2) All business relationships between Fair IT yourself e.V. and the buyer are governed exclusively by the following General Terms and Conditions in the version in effect at the time the buyer places the order. The General Terms and Conditions of Fair IT yourself e.V. take precedence over all of the buyer’s business, delivery, contractual, and purchasing terms and conditions. The latter shall not become part of the contract, even if Fair IT yourself e.V. does not expressly object to them. These General Terms and Conditions shall apply even if Fair IT yourself e.V. carries out the delivery to the buyer without reservation while being aware of conflicting or deviating terms and conditions of the buyer.
§ 3 Offer and Conclusion of Contract
(1) Some of the products we offer are made of natural materials (cases) and may therefore differ slightly from the items shown in the store.
(2) While going through the ordering process, the buyer may make corrections to the order at any time, most recently on the order summary page in the checkout area under “Place Order.” The buyer can use the browser’s back button to go back one step in the ordering process.
(3) By submitting an order by clicking the “Submit Order” button, the buyer makes a binding offer within the meaning of Section 145 of the German Civil Code (BGB). Fair IT yourself e.V. will confirm receipt and the contents of the buyer’s order via email (order confirmation). This order confirmation does not constitute acceptance of the buyer’s offer.
(4) A contract between the buyer and Fair IT yourself e.V. is not concluded until Fair IT yourself e.V. delivers the ordered goods to the buyer.
(5) Fair IT yourself e.V. stores the order and the order information entered by the buyer. After completing the ordering process, the buyer can print out an order confirmation by clicking the “Print Preview” button.
§ 4 Prices
The list prices in effect at the time of the order, as shown on the FairITyourself.de website, apply. Prices are quoted ex Fair IT yourself e.V. headquarters, including value-added tax, but excluding packaging and shipping costs. Special offers can be arranged upon request for commercial customers and bulk purchasers.
§ 5 Deliveries and Shipping Costs
(1) Delivery will be made to the billing address provided by the buyer, unless the buyer has also specified a different shipping address when placing the order.
(2) The applicable shipping costs are listed separately under “Shipping Costs.”
(3) Fair IT yourself e.V. reserves the right to make partial deliveries, unless such partial delivery is clearly not in the buyer’s interest.
(4) If the buyer is a consumer within the meaning of § 13 of the German Civil Code (BGB), Fair IT yourself e.V. bears the risk of accidental loss or accidental deterioration of the goods until the purchased item is handed over to the buyer. If the buyer is an entrepreneur within the meaning of Section 14 of the German Civil Code (BGB), the risk passes to the buyer as soon as Fair IT yourself e.V. has handed over the goods to a carrier. This also applies to partial deliveries. The goods are deemed to have been handed over if the buyer is in default of acceptance.
(5) If the buyer is in default of acceptance or culpably fails to fulfill other obligations to cooperate, Fair IT yourself e.V. is entitled to demand reimbursement for the resulting damages, including any additional expenses. We reserve the right to assert further claims.
(6) If the customer exercises his right of withdrawal, he must bear the standard costs of return shipping provided that the delivered goods correspond to those ordered and are not damaged. In the event of a complaint due to an error on the part of Fair IT yourself e.V., return shipping is free of charge for the customer.
§ 6 Reservation of Delivery and Delivery Time
(1) Delivery of the purchased item is subject to availability. If the item is unavailable, the buyer will be notified immediately. If the buyer has already paid the purchase price and is not interested in a subsequent delivery, the full amount will be refunded immediately.
(2) Provided the ordered products are in stock, they will be shipped within the delivery time specified for the item after the order is received (for cash on delivery or invoice) or after payment is received (for prepayment, PayPal, or direct debit).
§ 7 Retention of Title
The delivered goods remain the property of Fair IT yourself e.V. until full payment has been made.
§ 8 Terms of Payment
(1) Fair IT yourself e.V. accepts payment in advance (bank transfer), cash on delivery (payment upon delivery), PayPal, credit card, and on account.
(2) Fair IT yourself e.V. will issue an invoice to the buyer for the ordered goods, which will be handed over to the buyer upon delivery of the goods. The invoice amount is due immediately upon receipt of the invoice—or, in the case of orders paid in advance or by direct debit, upon receipt of the order confirmation. No discount is available.
(3) In the event of late payment, a buyer who is a consumer is obligated to pay Fair IT yourself e.V. late payment interest at a rate of 5% above the base interest rate, unless Fair IT yourself e.V. can prove that a higher interest rate applies. For buyers who are business entities, the first sentence applies, provided that the default interest rate is 8% above the base interest rate.
(4) The buyer is entitled to set off against the purchase price claim only if the buyer’s counterclaims have been legally established, are undisputed by Fair IT yourself e.V., or have been acknowledged by Fair IT yourself e.V. Furthermore, the buyer is authorized to exercise a right of retention only if the buyer’s counterclaim is based on the same contractual relationship.
§ 9 Warranty
(1) The warranty provided by Fair IT yourself e.V. is governed by statutory provisions.
(2) The buyer is required to inspect the delivered goods immediately upon receipt and to report any complaints in writing within 14 days. Excluded from this are defects resulting from improper handling, alteration of the delivered item, or natural wear and tear. Due to the use of natural materials in the housing, minor variations in quality and color are inherent to the product and cannot be avoided during manufacturing. These minor variations do not constitute a material defect within the meaning of § 434 BGB, provided they do not impair the product’s technically sound functionality.
(3) In commercial transactions, the warranty is limited to two years, and Fair IT yourself e.V. is entitled to repair the product to the best of its ability or to provide a replacement free of charge. Repair will always be the first option.
§ 10 Liability
(1) The customer’s claims for damages or reimbursement of futile expenses are governed by these provisions.
(2) Fair IT yourself e.V. shall bear unlimited liability for damages resulting from injury to life, body, or health that are attributable to a negligent breach of duty by Fair IT yourself e.V. or an intentional or negligent breach of duty by a legal representative or agent of Fair IT yourself e.V., Fair IT yourself e.V. shall bear unlimited liability.
(3) With respect to all other liability claims, Fair IT yourself e.V. shall be liable without limitation only in the event of the absence of the guaranteed quality, as well as for willful misconduct and gross negligence, including that of its legal representatives and executive officers. Fair IT yourself e.V. is liable for the fault of other vicarious agents only to the extent of liability for slight negligence pursuant to § 10 ( 4.
(4) Fair IT yourself e.V. shall be liable for slight negligence only to the extent that a duty has been breached whose fulfillment is of particular importance for achieving the purpose of the contract (cardinal duty). In the event of a breach of a cardinal obligation due to slight negligence, liability is limited to the amount of damage that is typically foreseeable under the contract.
(5) Liability under the Product Liability Act remains unaffected.
§ 11 Force Majeure
(1) In cases where Fair IT yourself e.V. is unable to perform the service it is obligated to provide due to certain circumstances beyond its control (in particular, labor disputes or force majeure), Fair IT yourself e.V. shall be released from its performance obligations for the duration of the hindrance.
(2) If Fair IT yourself e.V. is unable to fulfill the order or deliver the goods for more than one month due to the circumstances described in paragraph 1, the buyer is entitled to cancel the contract.
§ 12 Final Provisions and Severability Clause
(1) All legal relationships arising from this contractual relationship are governed by the laws of the Federal Republic of Germany, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods.
(2) The place of jurisdiction for all disputes shall be Munich, provided that the buyer is a merchant or is treated as such, or if the buyer has its registered office or branch abroad.
(3) Should any provision of these Terms and Conditions be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. Rather, the contracting parties undertake, in such a case, to replace the invalid or unenforceable provision with a valid and enforceable provision that corresponds as closely as possible, within the limits of the law, to the economic and substantive intent of the original provision.
